These Terms & Conditions ("Terms") govern your access to and use of the website located at this domain (the "Site") and your purchase of any products offered on the Site. The Site is owned and operated by Ollie Botanical Group LLC, a Texas limited liability company ("Dandy," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility; age requirement
You must be at least 21 years of age to access the Site or purchase products from us. By using the Site, you represent and warrant that you are 21 or older and have the legal capacity to enter into a binding contract. We may require proof of age at any time, including age verification at delivery, and we reserve the right to cancel any order if we cannot reasonably verify that the purchaser is 21 or older.
2. Products; no health claims
Products sold on the Site are botanical products containing kratom (Mitragyna speciosa). They are not dietary supplements approved or evaluated by the U.S. Food and Drug Administration ("FDA"), and nothing on the Site is intended to constitute a health, medical, or drug claim of any kind. These statements have not been evaluated by the FDA. Our products are not intended to diagnose, treat, cure, or prevent any disease. Do not use our products if you are pregnant or nursing. Consult a physician before use if you have a medical condition or take any medication. Keep all products out of reach of children.
3. Legal status; restricted jurisdictions
Kratom is not a controlled substance under U.S. federal law, but its legal status varies by state and locality. We do not sell or ship products to jurisdictions where kratom is prohibited, including the states and localities identified in our Shipping Policy. You are solely responsible for knowing and complying with the laws of your state, county, and city. Any order placed for delivery to a restricted jurisdiction will be cancelled and refunded.
4. Orders; acceptance; pricing
All orders placed through the Site are offers to purchase, and we may accept or decline any order in our sole discretion, including for suspected fraud, address issues, quantity limits, or restricted-jurisdiction delivery. Prices, promotions, and availability are subject to change without notice. In the event of an obvious pricing or listing error, we may cancel affected orders and issue a full refund. Sales tax is collected where required by law.
5. Payment
Payment is due in full at the time of order. You represent that you are authorized to use the payment method provided and authorize us (and our payment processor) to charge the total order amount, including shipping and applicable taxes. We do not store full card numbers on our servers.
6. Shipping; risk of loss
Shipping terms, timelines, and restrictions are set out in our Shipping Policy, which is incorporated into these Terms. Title and risk of loss pass to you upon our delivery of the products to the carrier, except where applicable law provides otherwise. An adult signature (21+) may be required at delivery.
7. Returns and refunds
Returns and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms.
8. Acceptable use
You agree not to: (a) use the Site in violation of any applicable law; (b) purchase products for resale to, or on behalf of, any person under 21 or any person in a restricted jurisdiction; (c) interfere with the operation or security of the Site; (d) scrape, harvest, or copy Site content for commercial purposes without our written consent; or (e) misrepresent your identity, age, or shipping destination. We may suspend or terminate access for violations of this section.
9. Intellectual property
The Site and all content on it — including the Dandy name and logo, text, graphics, product descriptions, and page design — are owned by Ollie Botanical Group LLC or its licensors and are protected by trademark, copyright, and other intellectual-property laws. You may not use our marks or content without our prior written permission, except as necessary to view the Site for personal, non-commercial use.
10. Disclaimer of warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL OLLIE BOTANICAL GROUP LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SITE OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ANY ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless Ollie Botanical Group LLC and its members, managers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, or your misuse of the Site or products, including any purchase made for a person under 21 or for delivery to a restricted jurisdiction.
13. Governing law; disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts. You and Dandy each waive any right to a jury trial and agree that any claim must be brought individually and not as part of a class or representative action, to the extent permitted by law.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Changes take effect when posted to the Site; your continued use of the Site after posting constitutes acceptance. Orders are governed by the Terms in effect at the time the order is placed.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site and your purchases.
