Ollie Botanical Group, LLC (“Ollie Botanical Group, LLC,” “Ollie Botanical,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information of visitors to and customers of our website https://foreverdandy.com (the “Site”) and our related sales, customer service, and marketing activities (collectively, the “Services”). This Privacy Policy explains what information we collect, how we use and share it, and the choices available to you. By using the Site or purchasing our products, you agree to the collection and use of information in accordance with this Privacy Policy.

1.1 Information You Provide to Us
When you create an account, place an order, sign up for marketing communications, contact customer service, or otherwise interact with the Site, you may provide us with:

- Billing information, such as your billing address (payment card numbers are collected and processed directly by our payment processor (see Section 3)

We do not sell your personal information for money. We may share your information with:
- Service providers who perform functions on our behalf, such as our e-commerce/hosting platform (e.g., Shopify), payment processors, age- or identity-verification vendors, shipping and fulfillment carriers, email/SMS marketing platforms, customer service tools, and analytics providers
- Payment processors, who receive the payment information necessary to process your transaction; we do not store full payment card numbers on our own servers
- Shipping carriers, who receive the information necessary to deliver your order, including your name and shipping address
- Professional advisors and regulators, such as attorneys, auditors, or government authorities, where necessary to comply with law, respond to legal process, or protect our rights
- A successor entity, in the event of a merger, acquisition, financing, or sale of some or all of our business or assets

5. Age Restrictions and Product Eligibility
All purchases on the Site require age verification. Before you can complete an order, we require you to confirm your date of birth and, in some cases, to verify your age or identity through a third-party age-verification service, to confirm that you meet the minimum age required under applicable law to purchase kratom products. We do not knowingly sell products to, or collect personal information from, anyone under that age, and orders that cannot be age-verified will not be completed.
The legal status of kratom varies by state, county, and city, and is subject to change. We use the shipping address you provide, together with other order and location information, to automatically screen orders at checkout and to block or cancel purchases and shipments to states and localities where the sale, purchase, or possession of kratom is restricted or prohibited. If we are unable to confirm that shipment is permitted to your location, your order will not be completed, and we will notify you. This Privacy Policy does not constitute legal advice regarding the legality of kratom in any location, and the list of restricted jurisdictions may change without notice as laws change.
6. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide our Services, maintain business and tax records, resolve disputes, enforce our agreements, and comply with legal, regulatory, and age-verification recordkeeping obligations. Retention periods vary depending on the type of information and the purpose for which it was collected.
7. Data Security
We use administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
8. Your Choices and Rights
Depending on where you live, you may have certain rights and choices regarding your personal information, which may include the right to:
- Access, correct, or update the personal information we hold about you
- Request deletion of your personal information, subject to certain legal exceptions (such as records we must retain for age-verification, tax, or legal-compliance purposes)
- Opt out of marketing emails or text messages at any time, using the unsubscribe link in our emails, replying “STOP” to text messages, or contacting us directly
- Decline non-essential cookies through your browser settings, as described in Section 2
To exercise any of these choices, contact us using the information in Section 13. We will respond to verifiable requests within the time required by applicable law. We may need to verify your identity before fulfilling certain requests.
9. Children’s Privacy
The Site and our products are not directed to, and are not intended for use by, anyone under the minimum age described in Section 5, and in no event anyone under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child in violation of this policy, we will take steps to delete that information.
10. Third-Party Links
The Site may contain links to third-party websites or services that are not operated by us, including payment processors and social media platforms. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing them with information.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, our products, or applicable law. We will post the updated policy on the Site and revise the “Effective Date” above. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised policy.
12. California Privacy Notice
This section applies to California residents and supplements the rest of this Privacy Policy, as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”). It describes the categories of personal information we collect about California consumers, how we use and disclose it, and the rights available to California residents. It does not apply to information that the CCPA exempts, such as certain information collected from our own job applicants, employees, or contractors. 12.1 Categories of Personal Information We Collect
In the preceding 12 months, we have collected the following categories of personal information, as defined by the CCPA, from California consumers:
- Identifiers - such as your name, email address, mailing address, phone number, account username, IP address, and date of birth (collected for age verification)
- Customer records information - such as your billing address and, where applicable, information about the payment card used for your purchase (processed by our payment processor)
- Commercial information - such as products you have purchased, considered, or returned, and your order history
- Internet or other electronic network activity information - such as your browsing and click-stream activity on the Site, and your interactions with our marketing emails
- Approximate geolocation information - such as your shipping address and the general location inferred from your IP address, used to automatically screen orders and block or restrict purchases and shipments to states or localities where kratom sale is not permitted
- Inferences - such as preferences and characteristics we derive from the categories above, used to personalize marketing and improve the Site
We do not knowingly collect biometric information, precise geolocation, professional or employment-related information, education information, or sensory (audio/visual) information about Site visitors or customers. As described in Section 5, we may collect your date of birth to verify that you meet the minimum age required to purchase our products; we do not use this information for any purpose other than age and eligibility verification, fraud prevention, and legal compliance.
12.2 Sources, Purposes, and Retention
We collect the categories of personal information above directly from you, automatically through your use of the Site, and from the third parties described in Section 1.3. We use and disclose this information for the business and commercial purposes described in Section 3 (How We Use Your Information) and Section 4 (How We Share Your Information), and we retain it consistent with Section 6 (Data Retention).
12.3 Disclosures of Personal Information
For the business purposes described in Section 4, we disclose the categories of personal information listed in Section 12.1 to the following categories of third parties: our e-commerce/hosting platform, payment processors, age- and identity-verification vendors, shipping and fulfillment carriers, email/SMS marketing and customer service platforms, analytics and advertising providers, and professional advisors or government authorities where required by law.
12.4 “Sale” and “Sharing” of Personal Information
We do not sell personal information to third parties in exchange for money. However, if we use advertising or analytics cookies, pixels, or similar tools that allow third-party advertising partners (such as social media or search advertising platforms) to receive information about your activity on the Site for purposes of cross-context behavioral advertising, the CCPA may treat that activity as a “share” of your personal information, even though no money changes hands. We do not sell or share the personal information of consumers we know to be under 16 years of age.
If you would like to opt out of any such sharing, you may do so using the cookie or ad-preference controls on the Site (where available), your browser or device privacy settings, or by contacting us using the information in Section 13.
12.5 Your California Privacy Rights
Subject to certain exceptions, California residents have the right to:
- Know/Access - request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collecting it, and the categories of third parties with whom we have disclosed, sold, or shared it
- Delete - request that we delete personal information we have collected from you, subject to certain exceptions (such as information we must retain for age-verification, security, or legal-compliance purposes)
- Correct - request that we correct inaccurate personal information we maintain about you
- Opt Out of Sale/Sharing - direct us not to sell or share your personal information, as described in Section 12.4
- Limit Use of Sensitive Personal Information - direct us to limit our use of sensitive personal information to purposes necessary to provide the Services, to the extent we collect any (see Section 12.1)
- Non-Discrimination - not receive discriminatory treatment for exercising any of your CCPA rights
12.6 How to Exercise Your Rights
You may submit a request to know, delete, or correct your personal information by contacting us at support@foreverdandy.com or +1 844-435-6852. You may designate an authorized agent to submit a request on your behalf by providing the agent with written permission signed by you, or as otherwise permitted by law; we may still require you to verify your own identity directly with us.
To protect your information, we will take steps to verify your identity before fulfilling a request to know, delete, or correct, which may include matching information you provide to information we already have on file. We will respond to verifiable requests within 45 days, and may extend that period by an additional 45 days when reasonably necessary, with notice to you.
12.7 Shine the Light
California Civil Code Section 1798.83 (“Shine the Light”) permits California residents to request certain information about our disclosure, if any, of personal information to third parties for their own direct marketing purposes in the preceding calendar year. We do not currently disclose personal information to third parties for their own direct marketing purposes; if this changes, we will update this Privacy Policy and provide the notice and choices required by law.
